1. Agreement to These Terms
These Terms and Conditions ("Terms") govern your use of marlontoyota.com and the services offered by Marlon Car Sales. Marlon Car Sales is the trade name of Marlon Sanchez, a sole proprietor ("we," "our," or "us").
By using our website, submitting a form, or communicating with us, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use our Services.
2. Our Role as an Independent Broker
Marlon Car Sales is an independent vehicle broker.
We help customers locate vehicles, compare options, and connect with licensed dealerships. We are not a vehicle manufacturer or a lender. Unless we tell you otherwise in writing, we are not the seller of the vehicle.
Vehicles are sold by licensed dealerships. Your purchase or lease agreement is between you and the dealership. That agreement controls the final price, fees, warranties, and terms of your transaction.
3. No Affiliation with Toyota
Marlon Car Sales is not affiliated with, sponsored by, or endorsed by Toyota Motor Corporation, Toyota Motor North America, or any Toyota dealership. "Toyota," model names, and related logos are trademarks of their respective owners. We use them only to describe the vehicles we help customers buy.
4. Eligibility
You must be at least 18 years old and legally able to enter into contracts to use our Services.
5. Vehicle Information, Pricing, and Availability
We try to keep vehicle information accurate, but please note:
- Photos may be representative. Specifications, features, and colors are based on manufacturer or dealer data and may differ from the actual vehicle.
- Unless clearly stated, any price shown or quoted excludes taxes, tag, title, registration, dealer fees, and optional products.
- Manufacturer incentives, rebates, and special offers depend on eligibility and may change or end without notice.
- Inventory is subject to prior sale. A vehicle shown or discussed may no longer be available.
- Information on our website or in our messages is not an offer to sell. The final price and terms are only those in the written buyer's order or purchase agreement you sign with the dealership.
- We are not bound by typographical, pricing, or other errors, and we may correct them at any time.
6. Our Fees and Compensation
We will disclose any fee we charge you for our services in writing before you agree to it. We may also receive compensation from dealerships for transactions we help arrange.
7. Financing and Leasing
We are not a lender and do not make credit decisions. Financing and leasing are subject to credit approval by the dealership's lenders.
Any payment, rate, or term we discuss is an estimate only. Your actual terms depend on:
- your credit profile,
- your down payment,
- the vehicle, and
- the lender's approval.
8. Trade-Ins
Any trade-in value we provide is a non-binding estimate. It becomes final only after the dealership physically inspects the vehicle.
By submitting a trade-in, you confirm that:
- you have the right to trade the vehicle, and
- you have accurately disclosed its condition and any liens or loans on it.
9. Communications and Messaging Program Terms
Consent. When you provide your phone number and check the consent box on our forms, you agree to receive calls and text messages from Marlon Car Sales at that number. These may include marketing messages and messages sent using automated technology. When you opt in to WhatsApp messages or message us there, you agree to receive WhatsApp messages from us. Consent is not a condition of any purchase.
Program description. Messages may include:
- responses to your vehicle inquiry,
- appointment confirmations and reminders,
- pricing and inventory updates, and
- promotional offers.
Frequency and cost. Message frequency varies. Message and data rates may apply.
Opting out.
- Text messages: reply STOP at any time. You will receive one confirmation message, and then no further texts unless you opt in again.
- Help: reply HELP, or contact us at [email protected].
- WhatsApp: reply STOP or block our number.
- Email: use the unsubscribe link in any email.
- Phone calls: ask us to stop calling you.
- Timing. Consistent with Florida law, we limit marketing text messages and calls to the hours of 8:00 a.m. to 8:00 p.m. in your local time zone. We also send no more than three on the same topic within a 24-hour period.
Automated and AI-assisted messages. Some messages are sent or answered by automated tools, including AI assistants. You may ask to speak with a person at any time.
Call recording. If we record a call, we will tell you at the start of the call.
Carriers and WhatsApp. Wireless carriers are not liable for delayed or undelivered messages. Your use of WhatsApp is also subject to Meta's terms and policies.
Changed numbers. If you give up or change the phone number you provided, please tell us so we don't message the new owner of that number.
10. Acceptable Use
You agree not to:
- submit false information, or someone else's information without their permission;
- use the website for any unlawful purpose;
- scrape, copy, or harvest content or data from the website;
- interfere with the website's security or operation; or
- upload viruses or other harmful code.
11. Intellectual Property
All website content is owned by Marlon Car Sales or its licensors. This includes text, graphics, logos, design, and our own photography. You may not copy, modify, or distribute it without our written permission.
12. Content You Send Us
If you send us photos, reviews, testimonials, or other content, you give us a non-exclusive, royalty-free license to use it in connection with our Services. For example, we may share trade-in photos with dealerships. We will ask for your permission before publishing your name, image, or testimonial in our marketing.
13. Third-Party Services
Our Services may connect you with dealerships, lenders, and other third parties, or link to their websites. We do not control them and are not responsible for:
- their products, services, content, or practices, or
- the condition, warranty, or delivery of any vehicle they sell.
14. Disclaimers
The Services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Vehicle warranties, if any, are provided only by the manufacturer or dealership.
15. Limitation of Liability
To the fullest extent permitted by law, Marlon Car Sales is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services.
Our total liability for any claim related to the Services will not exceed the greater of $100 or the amount you paid us directly for our services.
16. Indemnification
You agree to defend, indemnify, and hold harmless Marlon Car Sales from any claims, losses, or expenses (including reasonable attorneys' fees) arising from:
- your misuse of the Services,
- your violation of these Terms, or
- inaccurate information you provide.
17. Governing Law and Venue
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute will be resolved exclusively in the state or federal courts located in Miami-Dade County, Florida. You consent to the jurisdiction of those courts.
18. Changes to These Terms
We may update these Terms at any time by posting a new version with an updated Effective Date. Continuing to use the Services after an update means you accept the revised Terms.
19. General
These Terms and our Privacy Policy are the entire agreement between you and us regarding the Services. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver of it.
